1. About this Licence
This End-User Licence Agreement (the "Licence") is an agreement between you and Savari. It sets out what you may and may not do with the Savari mobile app for Android and iPhone.
In this Licence, "the app" means the Savari mobile app and everything that comes with it: its code, screens, text, images, sounds and every update Savari releases for it. "Savari" means the operator of the Savari app and the Savari services.
This Licence covers the software only. Other Savari documents cover the rest, and you can read all of them in the Legal section of the Savari app:
- the Terms of Use cover using Savari: City rides, fares and offers, payments, wallets, the driving balance, the commission, cancellations and ratings;
- the Courier Terms cover sending and delivering parcels with Courier;
- the City to City Terms cover trips between cities;
- the Privacy Policy explains what information Savari collects, why, and what choices you have.
If this Licence and one of those documents say different things about the software itself, this Licence applies. On anything about the services, the other document applies.
By installing, opening or using the app, you accept this Licence. If you do not accept it, do not use the app and remove it from your phone.
2. Who can use the app
You may use the app only if the law that applies to you allows you to accept a binding agreement such as this one.
You sign in with a mobile number and a one-time code sent to that number. Use a number that belongs to you and an account that is yours. Do not sign in with another person's number, and do not let anyone else use your account.
One Savari account can be used as a passenger and, after approval, as a driver, a courier or both. The driver and courier parts of the app open only after Savari approves your registration, your vehicle and your documents, as the Terms of Use describe.
3. The licence Savari gives you
As long as you follow this Licence, Savari gives you a personal, limited, non-exclusive, non-transferable and revocable licence to download, install and use the app on phones that you own or control, in order to use the Savari services in Pakistan. That means you may use the app to:
- request City rides, send parcels with Courier and book City to City trips as a customer;
- manage your profile, wallet, trips, deliveries, messages and settings;
- register as a driver or courier and, once approved, receive requests, send offers and complete the rides and deliveries you agree to.
The app is free to download. Savari does not sell anything through the in-app purchase systems of Apple or Google. Money that moves through Savari, such as fares, wallet balances, the driving balance and the commission, is covered by the Terms of Use, not by this Licence.
You receive a licence to use the app, not ownership of it. Savari keeps every right that this Licence does not clearly give you. You may not sell, rent, lend, share, transfer or sublicense your licence to anyone else.
4. What you must not do
While using the app, you must not do any of the following, and you must not help or encourage anyone else to do them:
- copy, modify, translate or adapt the app, or build anything based on it;
- decompile, disassemble or reverse engineer the app, or try to extract its source code, except to the limited extent that the law gives you that right even though this Licence says otherwise;
- sell, rent, lease, lend, publish or distribute the app, or put it on a network or device where other people can use it without their own copy;
- remove, hide or alter a copyright notice, a trademark or any other ownership notice that appears in the app;
- use a modified or unofficial version of the app, or a bot, script or other automated tool, to sign in, send or accept requests, make offers, or read information from Savari's servers;
- fake your location or use any tool that reports a false position to the app, for example to appear close to a pickup point or inside a city;
- try to get around the fare range the app allows, the commission, the rule that City rides and Courier stay inside one city, the rule that a customer can have only one City ride request and one Courier request open at a time, or any other limit the app applies;
- create an account with false details, or upload photos, documents or vehicle details that are not genuine or not your own;
- probe, scan or test the security of the app or of Savari's systems, or try to reach any account, information or part of Savari's systems that is not meant for you;
- overload, interrupt or damage the app, Savari's servers or the networks they use, or introduce viruses or other harmful code;
- collect other people's names, phone numbers, locations, photos or other details from the app for any purpose other than the trip or delivery you are taking part in;
- use the app to break the law, to harass, threaten or cheat anyone, or to carry out fraud;
- use the app, its design or its information to create a product or service that competes with Savari.
If you break these rules, Savari may limit, suspend or end your use of the app, as section 13 explains.
5. Your phone, your connection and app permissions
You need a compatible Android phone or iPhone and an internet connection to use the app. Your mobile operator may charge you for the data the app uses, and those charges are yours to pay.
The app asks for your permission before it uses these parts of your phone:
- Location, only while you are using the app: to show where you are on the map, set pickup points, find drivers near you, send requests to nearby drivers and follow a trip or delivery. The app does not ask for permission to use your location in the background.
- Camera and photos: to take or choose your profile photo and, if you register as a driver or courier, photos of your vehicle and your documents.
- Microphone: for voice calls inside the app with the other person on your trip or delivery.
- Notifications: if you drive City to City journeys, to remind you shortly before a journey you are driving leaves. Offers, trip and delivery updates and messages about your account appear inside the app and do not need this permission.
You can refuse a permission or turn it off later in your phone settings. The features that need it will then stop working. For example, without location the app cannot show drivers near you, and without the microphone you cannot make in-app calls.
Because the app does not use background location, it shares a driver's or courier's location only while the app is in use. If Savari stops receiving a driver's location, the driver may be taken offline automatically.
When you ask it to, the app can open other apps on your phone, such as the phone dialer, your text messages app, Google Maps or Apple Maps. Those apps have their own terms, and this Licence does not cover them.
The app keeps you signed in on your phone so that you do not need a new code every time you open it. Anyone who can use your unlocked phone can therefore use your Savari account. Keep your phone locked, and log out before you hand your phone to someone else. If your phone is lost or stolen, tell Savari as soon as you can: open Help in the Savari app and choose Contact support.
6. Who owns the app
The app belongs to Savari and to the companies and people who license parts of it to Savari. This includes its code, design, screens, text, graphics, the name "Savari" and the Savari logo. They are protected by copyright, trademark and other laws.
This Licence does not give you any right to use the Savari name, the Savari logo or any other Savari brand feature, for example on a vehicle, a website or social media.
Maps, map data and map images shown in the app belong to the companies that provide them, and their own terms apply to them.
7. Content you add to the app
You keep ownership of what you add to the app, such as your name, profile photo, vehicle details and photos, documents, chat messages, ratings and reviews.
You allow Savari to store, copy, process and display that content, free of charge and without making it exclusive to Savari, only as far as needed to run, protect and improve the Savari services and to meet legal duties, and for as long as the Privacy Policy allows. For example, Savari shows your name and rating to the other person on a trip, shows a driver's vehicle details to the passenger, and lets its team review the documents a driver uploads.
When you add content, you confirm that:
- it is true and accurate, and a photo or document shows what it claims to show;
- you are entitled to add it, and it does not belong to someone else;
- it does not break the law or anyone's rights, and it is not abusive, threatening or misleading.
If you send Savari ideas or suggestions about the app, Savari may use them freely, without paying you and without owing you anything for them.
8. Updates and changes to the app
Savari may release updates that fix problems, improve security or speed, add or remove features, or change how the app looks and works. Depending on your phone settings, updates may install automatically.
Some updates may be needed before you can keep using the app, and an older version may stop working with Savari's servers. Savari does not promise that the app will support every phone model or every version of Android or iOS.
This Licence applies to every update, unless Savari releases an update with its own terms. Savari may also change, pause or stop any feature of the app, or the app as a whole. What happens to money held in your Savari account in that case is covered by the Terms of Use.
9. Services from other companies
The app works together with services run by other companies, including:
- Google Maps Platform, which provides the maps, place and address search, routes, distances and arrival times you see in the app;
- Google Cloud Translation, which translates text written by Savari's own team, such as help articles and notices, into the languages the app offers;
- Apple's App Store and Google Play, which deliver the app and its updates to your phone;
- your mobile operator, and the apps on your phone that Savari can open for you, such as the dialer, text messages, Google Maps and Apple Maps.
By using the maps in the app, you also agree to the Google Maps/Google Earth Additional Terms of Service (https://maps.google.com/help/terms_maps.html) and accept that Google handles information as described in the Google Privacy Policy (https://policies.google.com/privacy).
In-app voice calls run over the internet using WebRTC technology. Their quality depends on the connection of both phones.
Savari does not control these other services. Savari is not responsible for whether they are available, for the accuracy of what they provide, or for how they handle your information. Their own terms and privacy policies apply to your use of them.
10. Open-source software in the app
The app includes software components written by other people and published under open-source licences, such as the MIT, BSD and Apache 2.0 licences. Each of those components is covered by its own licence, not by this Licence.
Nothing in this Licence takes away any right that an open-source licence gives you over the component it covers. Where an open-source licence requires Savari to provide a copy of its notice or of the related source code, Savari will provide it when you ask through the Help section of the Savari app (Contact support).
11. If you downloaded the app from the Apple App Store
If you got the app from Apple's App Store, the following points also apply, and they take priority over anything else in this Licence that says otherwise:
- This Licence is made between you and Savari only, not with Apple. Savari, not Apple, is solely responsible for the app and its content.
- Your licence is to use the app on Apple-branded devices that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts linked to yours through Family Sharing may also use it where those rules allow.
- Apple has no duty at all to provide maintenance or support for the app. Support is Savari's responsibility.
- If the app does not meet a warranty that applies to it, you may tell Apple, and Apple will refund the price you paid for the app, if any. As the app is free to download, there is no price to refund. As far as the law allows, Apple has no other warranty duty for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are Savari's responsibility, to the extent this Licence does not exclude them.
- Savari, not Apple, is responsible for dealing with any claim by you or anyone else about the app or your use of it. This includes claims that the app causes harm, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that the app, or your having or using it, infringes their intellectual property rights, Savari, not Apple, is responsible for investigating, defending, settling and resolving that claim.
- You confirm that you are not located in a country that is under a United States Government embargo or that the United States Government has named as a "terrorist supporting" country, and that you are not named on any United States Government list of prohibited or restricted parties.
- When you use the app, you must also follow any agreement with another company that applies to that use, such as your mobile data agreement.
- Questions, complaints and claims about the app should be sent to Savari through the Help section of the Savari app (Contact support).
- Apple and its subsidiaries are third-party beneficiaries of this Licence. Once you accept this Licence, Apple has the right, as a third-party beneficiary, to enforce it against you.
12. If you downloaded the app from Google Play
If you got the app from Google Play, the Google Play Terms of Service also apply to your download and to your Google account. This Licence is not an agreement with Google. Savari, not Google, is responsible for the app, for supporting it and for dealing with claims about it.
13. Suspending or ending this Licence
You can end this Licence at any time by stopping using the app and removing it from every phone you installed it on. Removing the app does not close your Savari account. The Terms of Use and the Privacy Policy explain what happens to your account, your balances and your information.
Savari may limit, suspend or end your licence, or your access to some features, if:
- you break this Licence or the Terms of Use;
- Savari reasonably believes that you are misusing the app, committing fraud or putting other people at risk;
- the law, a court or a public authority requires it;
- Savari stops offering the app.
Separately from this Licence, the Terms of Use explain when driver or courier work is paused, for example while a document or vehicle has been rejected or has expired and has not been sent again, or while the driving balance is too low.
When your licence ends, you must stop using the app and remove it from your phones. Sections 6, 7, 11, 14, 15, 17 and 18 continue to apply after the licence ends. Ending this Licence does not cancel rights and duties that already existed before it ended.
14. What Savari does not promise
Savari works to keep the app safe, accurate and running well. Even so, Savari provides the app "as is" and "as available". As far as the law allows, Savari makes no promises about the app other than those written in this Licence and the Terms of Use, including no implied promise that the app is of satisfactory quality, right for what you want to use it for, or free of errors.
In particular, Savari does not promise that:
- the app will always be available, or will work without delays, errors or interruptions on every phone and network;
- maps, addresses, routes, distances and arrival times shown in the app will always be exact, or that a suggested fare will match the trip you actually take, because they rely on map data from other companies;
- a place will always be matched to the correct city when the app checks whether a trip or delivery stays inside one city;
- any driver or courier will make an offer on your request;
- notifications, chat messages and in-app calls will always arrive or connect on time.
The safety and emergency tools in the app depend on your phone, your network and the people and services they reach. Savari does not run emergency services. If you are in immediate danger, call the police or a rescue service directly.
Nothing in this section takes away rights you have under Pakistani law that no agreement can remove.
15. Limits on Savari's responsibility
As far as the law allows, Savari is not responsible for:
- indirect losses, or losses that could not reasonably have been foreseen when you started using the app;
- loss of profit, income, business or opportunity, including earnings a driver or courier misses while the app is unavailable;
- loss or damage to information stored on your phone, or damage to your phone or its other software, unless it was caused by Savari failing to take reasonable care;
- losses caused by services from other companies, by your phone or network, or by your breaking this Licence;
- losses caused by events outside Savari's reasonable control, such as power cuts, network failures, natural disasters or government action.
For claims about the app software under this Licence, Savari's total responsibility to you is limited to the amount you paid to download the app. Claims about fares, balances, the commission, trips and deliveries are covered by the Terms of Use, the Courier Terms and the City to City Terms.
Nothing in this Licence limits Savari's responsibility for fraud, for death or personal injury caused by negligence, or for anything else that the law does not allow to be limited.
16. Changes to this Licence
Savari may update this Licence when the app changes, when the law changes, or when the way Savari works changes. The current version, with its effective date, is always available in the Legal section of the Savari app.
A new version applies from its effective date. If you keep using the app after that date, you accept the new version. If you do not accept it, stop using the app and remove it from your phone.
17. Law and disputes
This Licence is governed by the laws of the Islamic Republic of Pakistan.
If you have a problem with the app, please contact Savari first through the Help section of the Savari app (Contact support), so that Savari has a chance to put it right.
Any dispute about this Licence that cannot be settled that way will be decided by the courts of Pakistan that have jurisdiction over it.
18. General terms
- This Licence, together with the Terms of Use, the Privacy Policy, the Courier Terms and the City to City Terms, is the whole agreement between you and Savari about the app.
- If a court decides that any part of this Licence cannot be enforced, that part applies as far as the law allows, and the rest of the Licence stays in force.
- If Savari does not enforce a right straight away, Savari has not given up that right and may still enforce it later.
- Savari may transfer its rights and duties under this Licence to another organisation that takes over the app, as long as your rights under this Licence are not reduced. You may not transfer your rights or duties under this Licence to anyone else.
- This Licence is available in English, Urdu, Turkish, Arabic and German. If a translation and the English text differ, the English text applies.
